Deposit/Payment: A non-refundable deposit is required at the time reservations are booked. Payments may be made as follows:
- Credit cards – Visa, MasterCard, Amex, Discover by calling 860-331-6080 or request electronic invoice. (2.5% CC fee applies)
- Check payable to Fairways to Heaven Golf Travel – Send to 10 Jim Gallagher Way Simsbury, CT 06070
- Wire ACH transfer payment to Bank of America – Acct #385010201514 – routing# 0260009593
Payment Terms as follows:
- A non-refundable deposit per person is due for all packages at the time reservations are booked to hold the itinerary. As all of our tours are custom, the deposit amount required may ultimately vary but remain non refundable
- Remaining balance due 90 days prior to travel.
Cancellations: All cancellations must be submitted in writing to Fairways to Heaven Golf Travel and are subject to the following per person cancellation charges:
- Greater than 90 days prior to arrival: Amount of deposit paid plus any penalties imposed by third party vendors (golf courses, hotels, etc.)
- Less than 90 days prior to arrival: 100% of total balance per person charge for the trip.
Note: When one member of a party cancels, it may affect the total package price for remaining members.
Amendments / Changes: Any customer initiated changes (dates, names, courses, tee times, etc.) requested more than 30 days after time of booking will result in a change fee of $50 per traveler plus any applicable increase in price. In addition to the change fee, customer is responsible for any upgrade fees charged by 3rd party vendors. Any reduction in fees by 3rd party vendors will be applied to customers final balance. All golf packages will be re-priced at the time the changes are made. Any additional cost which may result in a price difference from the original price will be paid at the time of change.
Note: All rates and fares that make up the tour cost are subject to change before final payment based on changes to tour components.
Responsibility: Fairways to Heaven Golf Travel functions as a third party intermediary. Services are not directly supplied by this company, such as accommodations, transportation, golfing, etc. Fairways to Heaven Golf Travel is not liable for any losses or breaches of contract or any omissions or careless actions on the part of suppliers that may result in any damage, loss, injury or irregularity to any customers for tours arranged by Fairways to Heaven Golf Travel. Fairways to Heaven Golf Travel shall not be responsible or liable for any personal injury or property damage, delayed departure, missed carrier connections, lost or damaged luggage, substitution of service, changes in fares, schedules or rates by any transportation carrier, hotel, resort or golf course, cancellation, double booking, missed reservations or lost tickets beyond its control. Furthermore, Fairways to Heaven Golf Travel is not now, and shall not become liable or responsible in any way whatsoever for any loss, injury, or damage caused by acts of God, acts of government or other entity, wars, civil disturbances, acts of terrorism, hijacks, thefts, or any other circumstances beyond its control.
Insurance: We strongly recommend you obtain travel insurance to protect yourself to the extent possible. You are responsible for obtaining travel insurance. We do not carry, and have no obligation to carry insurance coverage to protect you. Travel insurance can be secured through many companies. One option can be found here.
Fairways to Heaven Golf Travel does not endorse any particular insurance company.
Confidentiality: No confidential information of either party shall be disclosed to other parties without written consent of the other party.
Indemnification: To the fullest extent permitted by law, the client shall indemnify, defend and hold Fairways to Heaven Golf Travel (and its respective officers, directors, employees, agents, members, affiliates and subsidiaries) harmless from and against all claims, damages, losses, and expenses, whether direct, indirect, or consequential, including but not limited to all fees and charges of attorneys, court and arbitration costs (whether incurred in preparation for trial or arbitration, at trial or arbitration or on appeal in insolvency proceedings incurred by the indemnitee) as a result of or relating to a breach of any provision of this Agreement by the client unless the act or omission had been specifically approved by the indemnitee. This provision shall survive the duration of this Agreement.
Force Majeure: All hotel reservations, ground transportation, air travel if provided, and all services are provided from third parties. Fairways to Heaven Golf Travel acts as a travel agent, and not as a principal. If the planned event is postponed, cancelled, or relocated due to disaster, government action, acts of God, strikes or labor unrest (other than by our employees), riot or civil disorder, acts of terrorism, inclement weather, transportation strike or other event beyond our control not anticipated or known by either you or by us at the time of your purchase of your package(s), our liability, if any, is and shall be limited to providing you with similar trip within 2 years with price escalation and adjustment as necessitated by change of date(s), and we shall have no other and further liability to you. As stated earlier all deposits and payments are non refundable
